In 1990 President George Bush enacted the Americans with Disabilities Act (ADA). This law wonderfully pushed businesses to install access to their business with wheelchair ramps and aids in bathroom facilities. As technology advanced with the internet, and websites on the internet, the law now expanded the requirements to require that web communication be accessible to blind and visually impaired people. The ADA even offers tax incentives to offset the cost of providing such accessibility.

The Department of Justice has put a priority on website accessibility. They have ruled that all types of services, goods, and announcements presented to the public must be accessible, including those presented on the web.

This stricter law enforcement has led to a greater number of ADA related lawsuits. Unfortunately, many of these lawsuits can be identified as ‘trolling lawsuits”. With 96% of websites failing the ADA acceptability requirements, unscrupulous firms have focused on suing businesses to demand large damages and settlements, rather than seeking greater access. We have seen documents showing firms filing up to 50 such lawsuits in a single week. California has set a minimum damage settlement of $4,000 plus fees for each violation.
